Load-bearing wall: the wall that carries the building, not only the room

A load-bearing wall (in Georgian მზიდი კედელი) is a wall that carries vertical loads, meaning the floors, the roof and the walls above, and, in Georgia's seismic setting, horizontal earthquake forces, down to the foundation.

The legal line is drawn by Government Resolution No 255 of 2019 on construction permits. Its Article 4(3) makes moving, adding or removing interior partitions, and cutting openings in them, repair that needs no permit. Cutting an opening in a load-bearing structure inside the building is "reconstruction of load-bearing elements" under item (გ). We read the original text, amended up to 16 February 2026; a lawyer should confirm the current wording.

A buyer who sees such a wall only as the one holding up the floor above misses its second job. The seismic norm PN 01.01-09 counts walls as part of a building's earthquake defence, and in some frame buildings even infill that carries no floor belongs to that design. "Not load-bearing" is a question for the structural drawings, not for knocking on plaster. Our seismic resistance entry explains the norm.

Repair or reconstruction: how Resolution No 255 sorts wall work

Article 4(3) gives two lists. The repair list, "repair (renovation, equipping/finishing)", needs no construction permit; the reconstruction list does.

Annex 1 places the installation or dismantling of stairs, shop windows, doors, windows and other openings in Class I "if these works affect the building's load-bearing structures". We could not confirm whether Class I here means a simple building notice rather than a full permit, or which office handles it in Tbilisi and Batumi. Article 21(3)(გ) makes an expert assessment of the building's existing condition mandatory for any reconstruction; our construction permit entry explains the classes.

The sellers' word for a changed layout, გადაგეგმარება ("re-planning"), does not appear in the Resolution. In law it is repair if only partitions moved, and reconstruction if a load-bearing element was touched.

Piers, openings and belts: the seismic norm's rules for masonry walls

Under PN 01.01-09, Article 3(13), no structure may be altered without justification and a check, "even if it would increase resistance"; Article 3(8) forbids an extension to reduce the building's resistance. For brick and stone, Article 15 fixes wall geometry by design intensity.

Limits for load-bearing masonry walls PN 01.01-09, Art. 15 and Tables 9 and 10
RuleIntensity 7Intensity 8Intensity 9
Maximum distance between transverse walls (type I-II masonry)12 m9 m6 m
Minimum pier width between openings0.77 m (0.8 m for small concrete blocks)1.16 m (1.2 m)1.55 m (1.6 m)
Maximum opening width3.5 m3.0 m2.5 m
Minimum ratio of pier to opening0.330.50.75

Corner piers must be 25 cm wider, and openings above the Table 10 limits need a reinforced-concrete frame. Each floor and the roof need a continuous antiseismic belt (ანტისეისმური სარტყელი) at least 150 mm high, unless the floors are monolithic reinforced-concrete slabs resting on the main walls all round, with 4 bars of 10 mm at intensity 7 and 8 and of 12 mm at 9. Silicate brick is prohibited; fired brick must be grade 75 or above.

Frames follow other logic. Table 8 allows a reinforced-concrete frame with brick or small-block infill 7 storeys at intensity 8, but a frame whose infill does not affect its stiffness only 5. In the first system the infill is part of the earthquake design although columns carry the floors.

Whose wall is it? Structures as common property

Under Article 5(4) of the Law on Homeowners' Associations, a building's structures, facade, roofs, common balconies, stairwells, lifts, shafts and transit pipes are common property. Article 10(1) requires unanimity for a significant change. Article 10-1 leaves interior works free unless they enlarge a unit or create a new one, which, like demolition, needs two thirds.

We could not confirm whether association consent is legally required to cut a load-bearing wall inside one flat. Structures are common property, so ask both the association and a lawyer before any work starts. See our homeowners' association entry.

Fines for building without a permit Spatial Planning Code, Arts. 126, 130 and 131

For an unpermitted opening in a Tbilisi flat, Article 131(2) looks the closest line, but we could not confirm how inspectors apply it, and paying does not end the duty to remedy the work (Art. 126(5)). Our guide to unauthorised construction covers legalisation.

The Batumi collapse of 8 October 2021

Nine people died on 8 October 2021 when a section of a Soviet-era block of flats collapsed at 13, 26 May Street in Batumi; reports differ on whether it had 5 or 7 storeys. According to the case materials reported by Front News, the owner of a first-floor flat and workers he hired dismantled non-bearing and load-bearing walls and removed soil from the basement while his request, filed on 4 October, to combine the basement with the flat was still pending.

On 5 July 2022 the owner was sentenced to 4 years and two workers to 3 years. The defence argued that other illegal works caused the collapse. We do not name the owner, whose name sources spell differently. As the case materials describe it, walls came down before permission was granted, and bearing and non-bearing walls were handled as one job.

How load-bearing walls show up on plans, extracts and adverts

  • Developer and permit floor plans: load-bearing walls and columns are usually hatched or filled black, partitions drawn as thin lines. This is a drafting habit, not a legal rule, so read the legend.
  • Internal measurement drawing: under Resolution No 315 of 2024 it shows wall outlines and the net area between them, but does not say which walls bear loads. Rules Article 2(7) excludes walls, columns and openings in load-bearing and enclosing walls from the area, so removing a partition adds its footprint.
  • Public Registry extract: nothing about walls; a combined or split unit shows only as a changed area or a new cadastral code.
  • Frame descriptions: Housebook gives a black frame load-bearing walls only, Korter adds partitions, windows and a door; see our black frame entry.
  • ss.ge adverts: no wall field, but free text may say გადაგეგმარება or მზიდი კედლები ხელუხლებელია ("load-bearing walls untouched").

Treat "re-planned" as a question. If a wall hatched on the original drawing has gone or gained an opening, ask for the permit or notice behind it.

Worked example: a new doorway in a Tbilisi brick building

A buyer wants a 1.5 m doorway between kitchen and living room in a flat in a Tbilisi brick building. The drawings show that wall hatched.

  1. The category. It is reconstruction under item (გ), so the repair exemption does not apply.
  2. The condition check. Article 21(3)(გ) requires an expert assessment of the existing building first.
  3. The geometry. At intensity 8 the brick piers beside the doorway should be at least 1.16 m wide; anything wider than 3.0 m would need a reinforced-concrete frame.
  4. The neighbours. The wall is common property, so plan on asking the association.
  5. The area. The opening itself stays outside the measured area.

These figures are our reading of the tables; an engineer should confirm them for the real wall. We found no published price for a structural survey, so get more than one quote.

Resolution No 255 speaks of the wider მზიდი კონსტრუქცია (load-bearing structure) and of cutting a ღიობი in it, so expect those words, not only მზიდი კედელი, in Georgian permit papers.

Warning signs around load-bearing walls

  • An open-plan flat in an old block with no papers. Ask what was removed, and when.
  • Trusting a knock test. Infill in a frame building can be part of the seismic design.
  • Starting before the decision. In Batumi the walls came down while the application was pending.
  • Assuming your flat means your walls. Structures are common property.
  • Missing late defects. A structural defect in commissioned work can be claimed for 5 years from acceptance, other defects for 1 year (Civil Code Art. 655); the handover act entry shows why that date matters.

To be added by the team: scans and photos the team should add: a redacted developer floor plan with load-bearing walls hatched and partitions in thin lines, a redacted internal measurement drawing under Resolution No 315, and a photo of an antiseismic belt exposed during a renovation. Remove addresses and cadastral codes before publishing.

How to plan a layout change around load-bearing walls

  1. Get the structural drawings

From the developer, the permit file or the association.

  2. Mark every wall

Hatched walls, columns and diaphragms stay unless an engineer agrees.

  3. Commission an assessment

An expert report on the building's existing condition.

  4. Ask the association

    Structures are common property.

  5. Obtain the permit or notice

    Before any wall is touched.

  6. Keep the papers

    Future buyers will ask.

Frequently asked questions

What is a load-bearing wall?

A wall that carries floors, the roof and the walls above, and earthquake forces, down to the foundation.

Do I need a permit to move a partition?

No. It is repair under Resolution No 255, Art. 4(3), item (ა).

Can I cut an opening in a load-bearing wall?

Only as reconstruction under item (გ), after an expert assessment of the building's condition.

Who owns the load-bearing walls in a block of flats?

Structures are common property under Article 5(4) of the Law on Homeowners' Associations.

How wide may an opening in a Tbilisi brick wall be?

Up to 3.0 m at intensity 8; wider needs a reinforced-concrete frame.

What happened in Batumi in 2021?

Part of a residential block collapsed on 8 October 2021 and 9 people died; walls had been removed while a permission was pending.

Does a registry extract show load-bearing walls?

No. Use the developer's or the permit drawings.

Does removing a partition change the flat's area?

Yes. Walls are excluded from measured area under Resolution No 315, so the footprint is added.
