Living area: one Georgian phrase, two different meanings

Living area (საცხოვრებელი ფართი) means either the combined floor area of a flat's living rooms only, a Soviet-era measuring habit that no current Georgian registry document records, or, in Georgian law and tax practice, residential space as a category of use, set against non-residential space.

We found no Georgian statute defining living area in the rooms-only sense. Government Resolution No 315 of 3 October 2024, in force since 1 January 2025, requires each internal measurement drawing to state whether a unit's function is residential or non-residential (Rules Art. 2(3)(ე), text on Matsne). The Instruction on the Public Registry, Order No 487, then has the extract show the unit with one area figure next to its purpose (Art. 6(4)(დ)). The Tax Code uses the same Georgian words when it sets a 5% rate on income from renting out residential space for living (Art. 81(2)).

A buyer from Russia, Ukraine or Kazakhstan usually expects two numbers: жилая площадь, the sum of the living rooms, and общая площадь, the whole flat. ConsultantPlus summarises Russia's Housing Code Art. 15(5) as keeping the two apart. A Georgian extract gives a single figure, and it is not the rooms-only one, so when a seller says საცხოვრებელი ფართი, ask which meaning is intended. How that registered figure is measured is explained under total area.

Residential status in the registry and on the drawing

Since 2025 the paperwork behind every registered flat answers the question "residential or not?" before it answers "how many square metres?". Resolution No 315 lists the data an internal measurement drawing must carry, and two of its fields deal with use rather than size.

Use fields on an internal measurement drawing Government Resolution No 315 of 3 October 2024, Rules Art. 2(3)
FieldValues allowedRule
FunctionResidential or non-residentialArt. 2(3)(ე)
Residential categoryResidential apartment (საცხოვრებელი ბინა); multi-apartment residential house; individual residential house; blocked house ("townhouse"); mansardArt. 2(3)(ვ)
Non-residential categoryOffice, trade or commercial space, warehouse, parking, basement, attic and othersArt. 2(3)(ზ)
AreaA single figure for the unit, with room-by-room dimensions on the planArt. 2(3), 2(7)

Nothing in that list asks for a rooms-only subtotal. On the extract, the purpose line is where the legal meaning of living area surfaces, as საცხოვრებელი or არასაცხოვრებელი; our guide to reading a Public Registry extract covers the other lines.

Planning law sorts space the same way. Resolution No 255, the permit regulation, makes a design break its floor space down into residential, office, commercial, parking, storage, common and auxiliary areas (Art. 13(1), text on Matsne). A developer's "residential area" is space by function across a building, never the bedrooms of one flat.

When "residential" changes the tax rate

For an owner who lets, the legal meaning matters more than any measurement. The test is how the space is used, not how many bedrooms it has.

Where the Tax Code turns on residential space Tax Code of Georgia, Art. 81; Public Ruling No 143 of 14 May 2026
SituationRuleBasis
Individual lets residential space for people to live in5%, with no deductionsArt. 81(2)
Individual earns other income, including rent from non-residential space20%, unless the Code says otherwiseArt. 81(1)
Individual sells a residential apartment or house with attached land at a gain5% on the gainArt. 81(3)
Individual sells a room that is part of hotel infrastructureNot a residential flat for the tax on the gain, whatever it looks like insidePublic Ruling No 143

Public Ruling No 143 of 14 May 2026 covers income tax when an individual sells an asset, and for that purpose it puts it plainly: the registry record matters, but the actual functional purpose decides whether a property is a residential flat, so a studio with a bed and a kitchenette that belongs to a hotel is taxed as another asset when sold. The ruling does not deal with the 5% rental rate, and it adds that renting a home out does not on its own alter its residential status; how the tax authority treats rent from hotel-type units we could not confirm. Ask an accountant how that applies to a given unit; our pages on aparthotel units and rental income tax cover the practice.

Paragraph numbers in Article 81 have shifted between versions, so quote them from the consolidated text on Matsne. We could not confirm how Batumi hotel-type units sold as "residential" are recorded, so read the purpose line for the specific unit.

Living area in surveys and market reports

Analysts use the phrase in at least three ways, so check which one sits behind a headline figure.

What "living area" counts in Georgian data Geostat; Galt & Taggart
Publisher and seriesWhat is measuredFigure
Geostat, Household Integrated Survey 2014Two separate variables: residential floor space ("LivingS") and whole dwelling floor space ("WholeS")Variables only
Geostat, household energy surveyTotal area and heated area; no living-area variable36.4% of households heat only 16 to 30 m² in winter
Galt & Taggart, Tbilisi permits, 2025Class III and IV permitted area, "living + balcony"1,734 thousand m², 208 permits
Galt & Taggart, Tbilisi permits, first 7 months of 2026Same series1,001 thousand m²
Geostat, completed residential area, Tbilisi 2025Floor area of residential buildings finished in the year1,768,848 m²

Galt & Taggart summed up 2025 as "permitted living area 1.7 million m2", 4.2% down on the year but still 32% above the 2015 to 2022 average. That is whole flats plus balconies, a planning quantity that measures supply, which our page on Tbilisi apartment supply follows, not bedroom space. The 2014 survey is the only Georgian source we found that kept rooms and the whole dwelling as two numbers.

Looking for the rooms-only figure on real paperwork

The Soviet-style number has to be built by hand from the one document that shows each room.

  • Registry extract: one area figure for the unit and a purpose line reading residential (საცხოვრებელი) or non-residential (არასაცხოვრებელი). No living area, and no split for balconies.
  • Internal measurement drawing (შიდა აზომვითი ნახაზი): the area of each room is shown on the plan, so the bedrooms and living room can be added up. It is the only official source for a rooms-only total.
  • ss.ge listing: fields "Total area", "Room" (ოთახი) and "Bedroom" (საძინებელი); no living-area field on the listings checked on 28 October 2026.
  • Soviet-era papers: old inventory cards or privatisation documents may list საცხოვრებელი ფართი separately. We found no sample to confirm it.
  • Tax return or rental register: the phrase is legal here, and the 5% route needs residential space let for living.

Room counts on ss.ge include the living room: one listing showed 59 m² of total area, 2 rooms and 1 bedroom. So a "3-room" flat has 2 bedrooms.

Worked example: a 59 m² advert read by a buyer from Almaty

Our illustration, with no prices added: a buyer used to Russian-language adverts finds that Tbilisi flat and asks for the жилая площадь.

  1. No figure exists. The extract shows 59 m², the purpose and the floor. That is normal, not evasive.
  2. The drawing supplies it. The bedroom and the living room are added; kitchen, hall, bathroom and balcony are left out.
  3. The purpose line reads residential. Let to a tenant who lives there, the flat can use the 5% rate of Art. 81(2); let as an office, the general 20% rate applies (Art. 81(1)).
  4. The price per m² is on 59 m². ss.ge divides the asking price by total area, so set against a home-market price per m² of living rooms the flat looks cheaper than it is.

Rooms only, whole flat, residential use or heated space?

Georgian, Russian and English sources mix five ideas under similar words.

Terms easily mistaken for living area Res. 315; Order No 487; Tax Code Art. 81; Geostat; Tbilisi K-2 rules
TermWhat it coversWhere you meet it
Living area, rooms onlyBedrooms and living room, without kitchen, bathroom, hall, storage or balconiesRussian-language habits; old Soviet papers; not on a current extract
Total areaThe whole unit, the figure the registry recordsExtract, drawing, listings, price per m²
Residential space (tax sense)A category of use, opposed to non-residential; for the tax on a sale, actual function decidesTax Code Art. 81, Public Ruling No 143
Habitable mansard or atticListed as a residential category by Res. 315; in Tbilisi density rules an attic over 1.6 m high counts at 3/4 for K-2Drawings and building permits
Heated areaThe part of the home warmed in winterGeostat energy survey

The K-2 rule is from Tbilisi's 2016 rules as first published; a lawyer should confirm the current wording. The opposite of the residential category is commercial space, and the spaces a rooms-only count drops are explained under loggia and balcony.

Living area across Georgian, Russian, Hebrew and Arabic

Each language needs a measurement form and a legal form.

On a current Georgian extract or sale contract, საცხოვრებელი describes the purpose of the unit, residential as against non-residential, while its size is the total area (საერთო ფართი) taken from the measurement drawing.

Misreadings of living area that mislead buyers

  • Treating the extract figure as rooms only. The registered figure is the whole unit. A buyer who reads it as жилая площадь overestimates the bedrooms.
  • Assuming "residential" follows the furniture. Under Public Ruling No 143 the actual function decides when a unit is sold; a room within hotel infrastructure is not a residential flat, kitchen or no kitchen.
  • Quoting an old Soviet living-area figure in a contract. We could not confirm how such figures were measured, and the current registry does not record them. Use the current drawing; our Soviet and new buildings comparison covers the series.
  • Counting rooms as bedrooms. On ss.ge the living room is one of the rooms.

To be added by the team: scans for the team to add: a redacted internal measurement drawing with the bedrooms and living room highlighted, a redacted extract showing the purpose line "საცხოვრებელი", and an ss.ge screenshot with the "Room" and "Bedroom" fields circled. Remove names, personal numbers and flat numbers first.

Working out the living area of a Georgian flat

  1. Read the purpose line

Residential or non-residential on the extract.

  2. Note the total area

The one figure the registry holds.

  3. Ask for the measurement drawing

    Room-by-room areas on the plan.

  4. Add the living rooms

Bedrooms plus living room, nothing else.

  5. Match the room count

ss.ge rooms include the living room.

  6. Plan the use

Living tenants keep the 5% rental route.

Frequently asked questions

Does a Georgian registry extract show the living area?

No. It shows one area figure for the unit, plus purpose, floor, entrance and number (Order No 487, Art. 6(4)).

Is living area defined in Georgian law?

We found no current definition in the rooms-only sense. The law uses residential space as a category of use.

How can I find the area of the bedrooms and living room?

Add up the room areas shown on the internal measurement drawing.

Which area is the price per m² based on?

Total area, the figure the registry holds and ss.ge shows.

What does "residential" mean for tax?

Space actually used for living. Letting it to people who live there allows the 5% rate (Tax Code Art. 81(2)).

Is a hotel room with a kitchen residential?

Not for the tax on its sale, if it is part of hotel infrastructure (Public Ruling No 143 of 14 May 2026). The ruling does not deal with rental income.

Does a "2-room" flat on ss.ge have 2 bedrooms?

No. The room count includes the living room, so it usually means 1 bedroom.

What is "permitted living area" in market reports?

Galt & Taggart's measure of new Tbilisi permits, whole flats plus balconies: 1,734 thousand m² in 2025.
